The Law and General Information applying to Terms and Conditions
These terms and conditions are governed by English Law. You and the Company both agree to submit to the exclusive jurisdiction of the English courts. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
These terms and conditions gives you information about the Company and the legal terms and conditions (Terms) which we (Dynamic Franchises Ltd) promote any of the services listed on our website to you, and you purchase driving lessons with a driving instructor (Instructor)

Information on our website may be changed periodically without notice. It is your responsibility to regularly check our website for any changes. We recommend that you print off and retain for your own records a copy of these terms and conditions from time to time.
We are Dynamic Franchises Ltd, a company registered in England and Wales under company number 09444464 and with registered office 1st Floor Dynamic Franchises and our VAT number is 209 293 504. We are at Ernest Wilson Buliding 62 Geldred Road Gildersome Leeds LS27 7LG we trade as Dynamic Franchises Ltd and operate the websites www.drive-dynamics.co.uk.
Please ensure that you read these Terms carefully, and check that the details on the Booking Form and in these Terms are complete and accurate, before you submit the Booking Form.

About you; The Pupil

Driving tuition is only available to you if you meet the following criteria:
Aged 17 or over, or aged 16 or over and in receipt of the higher rate of Disability Living Allowance (mobility component): and
Hold a valid United kingdom provisional driving licence; and
Be legally entitled to drive in the United Kingdom

Your Instructor, Insurance and Kan Kan Driving School

Your Instructor is a self-employed franchisee of Dynamic Franchises Ltd Franchisee, and adheres to our terms of business and code of conduct (‘Kan Kan Driving School’, ‘we’, ‘us’, ‘our’)

Dynamic Franchises Ltd sources an instructor in your area and receives payments on their behalf.

Where Dynamic Franchises Ltd makes bookings with, or supplies any information or documentation to you, or processes any payments for your lessons, they do this on behalf of your instructor.

The contract for driving lessons is between you and your Instructor.

Your instructor will carry the appropriate motor insurance, should you be involved in a collision as a learner driver whilst in control of driving the instructor’s tuition vehicle.

Booking your lessons

Please ensure that you read these Terms, and check the details on your booking form are complete and accurate before you submit the booking form.

When you submit you’re booking form to us, this does not mean your booking for driving lessons has been accepted.

The terms and conditions will become binding when your instructor contacts you to confirm the date and time that your driving lessons will commence. It is at this time that the contract between you and your Instructor will come into existence.

If you cannot be supplied with driving lessons, we will inform you of this and we will not process your booking enquiry.

Your lessons will be taken in a manual vehicle unless an automatic is specifically requested at the time of the booking.

Unless specifically requested at the time of the booking, either a male or female Instructor will be provided for your lesson.

The Contract for your driving lessons is made solely between you and the Instructor (who is a Franchisee of Dynamic Franchise Ltd.). All financial transaction are between you and the instructor, including pre-paid lessons paid direct to us.

You and Your Instructor are responsible for agreeing all matters relating to the timing, location and duration of individual lessons. You must keep the Driving Record Card up to date at all times.

You must notify your instructor of any matters which affect your ability or entitlement to have driving lessons, for example, but not limited to, any lack or loss of a valid UK provisional driving licence.

Prepaid Lesson(s) must be taken by you within six months of the contract being formed unless agreed by us or Your Instructor in writing. You will not be entitle to a refund after the expiry of this period.

Offers and price Charges

Prices for standard single lessons vary, and are set out in our price list in force at the time that the booking is confirmed. Please contact us for the standard pricing structure.

Dynamic Franchises Ltd presents a great range of offers and discounts to new learner pupils on learning to drive. Dynamic Franchises Ltd reserves the right to introduce (and withdraw) special offers from time to time.

Special Offers are only available to pupils who have not booked their practical driving test prior to booking the Special Offer Lessons unless agreed otherwise with your Instructor.

If Pupils book their practical driving test prior to the last Special Offer Lesson we reserve the right to charge you the full price for the Lesson(s) after the booking.

Special Offers are conditional upon you having regular lessons and not having a break of more than 14 days between Lesson(s) unless agreed by Your Instructor or Us. Where a breakage of more than 14 days occurs we reserve the right to charge you the full price for any remaining Lesson(s) and/or withdraw any free Lesson(s) under the Special Offer.

All offers are limited to new pupils, and one offer per pupil. These offers are not available to pupils who have already taken a lesson with a Kan Kan Driving Instructor, or who have already booked their test, and cannot be used in conjunction with any other offer. Special offers are non-transferrable.

The Session Lesson Offer:
The offer is for five, seven, ten or twenty driving lessons.
Full payment of the lessons must be made at the time of booking.
The £99 Beginners offer: 10@£99
Made up of 6 hours of lessons, taken in 3 x 2hour lessons, with the final 4 Lessons saved until the week of the test.
The 4 final hours Lessons are conditional upon you having regular lessons and not having a break of more than 14 days between lessons; In that event the 4 hours lessons will be forfeited.
The Session Lesson Offer 10@£99 is only available to pupils who have had three hours or less driving lesson experience.
The final four hours of the Session Lesson Offer are to be taken during the 14 days prior to your test. Where additional Lessons are required before your test these will be charged at the standard rate.
All other lessons will be charged in accordance with our standard pricing structure which may vary from time to time.
The offer is subject to availability.
The Intermediate £99 offer: 7@£99
Made up of 4 hours of lessons taken in 2 x 2hour slots with the final 3 Lessons being saved for the week of your test. The 3 hours in your final week are conditional upon you having regular lessons and not having a break of more than 14 days between Lesson(s) unless agreed by Your Instructor. Where a breakage of 14 or more days occurred the 3 hours will be forfeited.
All other lessons will be charged in accordance with our standard pricing structure which may vary from time to time.
The offer is subject to availability

Two Hour Taster Lesson (2@24) offer:
The offer is for a two hour driving lesson for £24.
Full payment must be made at the time of booking.
After the Two Hour Taster Lesson, but within a 7 day period, a further 4 two hour lessons (4 saved for the test week) may be purchased for £75. Lessons purchased under this offer will then be under the terms as per the 10@99 offer.
The offer is subject to availability.

The 20 hour lessons offer:
Price tariff varies on the postcode area. For current offer price please contact 03333 01 3333.
20 lessons available for beginners (0-2 hours driving experience) only and is made up of 16 hours of lessons at an hourly rate per hour with the final 4 lessons being free of charge. All lessons are to be delivered in 2 hour slots. The final 4 hours are saved for the week of your test, and conditional upon you having regular lessons and not having a break of more than 14 days between lessons; In that event the 4 hours will be forfeited.
All other lessons will be charged in accordance with our standard pricing structure which may vary from time to time.
The offer is subject to availability.

Ultimate Pass Course (£2200) offer:
The offer is for unlimited driving lessons over and up to a period of six months, up to a maximum of 60 hours in total and subject to Instructor availability.
Full payment of the Ultimate Pass Course must be made at the time of booking.
Your Instructor will book your practical driving test at the instructors’ discretion of starting the Ultimate Pass Course.
All other lessons will be charged in accordance with our standard pricing structure which may vary from time to time.
The offer is subject to availability.
Gift Vouchers:
Gift Vouchers may be redeemed in full or part against any Dynamic Franchises Driving Lessons, (including the Ultimate Pass Course, but excluding the Two Hour Taster Lesson Offers).
Voucher expiry is shown on the face of the voucher. The Voucher expiry is 3 months from the date of purchase.
Dynamic Franchises Ltd accepts no liability for lost or stolen vouchers.
Dynamic Franchises Ltd reserves the right to refuse any vouchers that are damaged, defaced or altered in any way.
Vouchers are not for resale.
All Driving Lessons are subject to our Pupil Terms and Conditions.
All other lessons will be charged in accordance with our standard pricing structure which may vary from time to time.

Price Changes

We reserve the right to change the price of all our lessons from time to time.
The cost of the prepaid tuition is based on the lesson price in force at the time of booking in, with the exception of the circumstances set out below will be honoured for 6 months thereafter irrespective of any price increase that may occur between the date of booking and when the lessons are taken.

Any unused lessons remaining after 6 months have elapsed shall have any lesson price increase applied prior to the lessons which shall become payable by you. You will not be entitled to a refund after the expiry of this period.
Circumstances where, if you have prepaid, you will be either be required to pay an additional amount beyond the cost of your pre-paid lessons (as applicable):
1.Where you have moved postcode area and requested reallocation to another instructor because your current instructor does not operate in the new postcode area, you will be required to cover any difference in the hourly rate between those instructors where your new instructor charges a higher hourly rate. An Administrative charge will apply.
2.Where you have requested to switch instructors within the same postcode area and your new instructor charges a higher hourly rate than your previous instructor, you will be required to pay the difference in the hourly rate, plus an administration charge. You will also forfeit the remaining 4 Free Hours.
3.Where you have requested to switch instructors in the same postcode area and your new instructor charges a supplement (for example an additional fee for tuition in a car with automatic transmission), you will be required to pay any such supplement, plus an administration charge. You will also forfeit the remaining 4 free hours.
4.Where you have not undertaken any lessons for a period of three months and have been reallocated an instructor after a price rise in tuition has taken place you will be required to pay the difference in price for your remaining lessons, plus an administration charge. You will forfeit the remaining 4 free lessons.

Payments and Lesson Bookings

You must pay for any lessons at least 48 hours before the start of the lesson by using one of the following methods:

1.Payment by credit or debit card by telephoning Kan Kan on 03333 01 3333. A handling fee of 1.8% plus VAT is applied to credit card transactions made to the Customer sales centre or on line. (This charge does not apply to payments made by debit card). A booking and administration fee of £2.75 will be charged in addition to the price of the Lesson(s) bookings made by telephone.

2.By a validated Dynamic Franchises Driving School voucher. Please note vouchers are valid until the date shown thereon. Voucher and gift cards have no cash value and have to be redeemed against lessons. Vouchers are not transferable once they have been redeemed.

3.Payment by cash or cheque direct to your instructor (any cheque must be made payable to your instructor).
Dynamic Franchises Limited has no responsibility or liability to you for payments made by any other means. If you pay your instructor directly by any method, you should obtain a receipt. Dynamic Franchises Ltd accepts no responsibility for any payments made directly to instructors.

Once the booking has been made, we will forward your details to the Instructor who we assign to you. The instructor will contact you within 5 working days to confirm the date, time and location of your lessons, which is when these terms and conditions come into place.

If you’re Instructor or we book your practical driving test for you on your behalf, you must pay the cost of the test fee to your Instructor or to us prior to the driving test being booked. This payment is in accordance with the driving Standard’s Agency Fee structure and is Non – Refundable, including if you cancel you’re driving test for any reason.

Changes to your Lessons

If you or your instructor wishes to change a lesson a minimum of 48 hours prior notice should be given. In the unlikely event that your instructor cancels a lesson without giving this minimum period of notice your instructor shall rearrange the lesson. Changes by you must be made directly between you and your instructor.

Where a Force Majeure Event means that you cannot have a lesson as per your booking, you and the Instructor should reschedule the lesson as soon as is reasonable possible after the Force Majeure event is over.

If the Instructor needs to change a pre booked lesson at short notice due to mechanical fault or breakdown of the vehicle, your instructor will contact you and re arrange the lesson.

Please note that in the event of you having booked your driving test, the Driving Standards Agency (DSA) stipulates that you need to give three clear working days to cancel your test. This may mean that you may/will lose your DSA test fee if your instructor says you are not ready for test within this three day notice period.

Transferability of lessons

You cannot sell or transfer lessons which have been purchased in your name to any other person.

Prevention of fraud

Your lessons are only valid if they are purchased through the channels outlined in the ‘Payments and lesson bookings’ section set out above. If your lessons have been purchased through another source please contact us immediately.

In the event that some or all of your lessons were not purchased in accordance with the foregoing terms, Dynamic Franchises Limited reserve the right to suspend these lessons in your account, with immediate effect.

An investigation will then be conducted by Dynamic Franchises Limited in order to check the validity of the purchase. Where the results of the investigation determine that the lessons are not valid they will not be provided to you and Dynamic Franchises Limited shall have no liability in these circumstances.

Customer care

Your contract is between you and your Instructor (who is a franchisee of Dynamic Franchises)
For the avoidance of doubt all financial transactions are between you and the instructor including pre-paid lessons paid direct to us.
In the rare event of any problem arising, you should resolve this with your instructor in the first instance. We recommend no further lessons are taken until the matter is resolved.

In the unlikely event that you are unable to reach a satisfactory conclusion, we will be happy to investigate further, following your initial contact to resolve the matter with the Instructor, until the matter is resolved. –
Please note that we will require evidence of any financial transactions and lesson times before we are able to investigate. Therefore, it is imperative that your Driver Record (provided to you by your instructor, and also via email at the time of a pre-paid booking) details are kept accurate and up to date to verify your claim.

We are unable to investigate any matter on your behalf without an up to date Driver Record.

Complaints procedure

If you have any concerns or complaints about any part of your driving tuition which cannot be resolved with your instructor, please contact the Customer Service Centre: 03333 01 3333.

Where the Customer Service Centre is unable to resolve your complaint to your satisfaction, you will be entitled to escalate the matter to Our Customer Services Department by writing to Customer Services at the address shown above.

The Customer Care team will use reasonable endeavours to respond to your written query within 7 to 14 working days.

Refund Policy and Procedure

If we are Unable to find an Instructor for you, we will inform you within 14 days and refund the money into your account.

Unless we cannot find an Instructor, you contact your Instructor for a refund. Your contract is between you and your Instructor. However any issues should be reported back to the customer Services team on 03333013333 option 4.

You may cancel a booking for lesson(s) within 14 days of the Booking by completing the Cancellation Form set out at the end of these Terms and Condition and sending this to your instructor or Us. If you have made any payment in advance of the lesson(s) Your Instructor will rearrange your Lesson (s) or refund these amounts to you within 14 days.

1.
If you have taken lesson(s) at the time of cancellation you will not be eligible for a refund on any lessons taken.

2.
Part refunds are the responsibility of Your Instructor once lessons have commenced.

3.
Where it is possible to do so, we will refund you using the same method you used to pay for your lessons when you made the payment. If for any reason we are unable to do this, we reserve the right to refund you by any other method we deem appropriate.

4.
We may request additional information from you to confirm your identity in order to comply with the Money Laundering Regulations 2007; we will also use this information to ensure adherence to our Merchant Operating Instructions for card collection facilities.

5.
Refund of partial block booking will be made pro rata on any lessons not taken.

6.
In the event of a ‘session lesson’ offer, no refund will take place for the final free hours once the first lesson has been taken.

7.If you have paid using a prepaid Kan Kan gift voucher, we will not be able to proceed to any refund after redemption of the card or voucher.

Any refunds in the first instance will be subject to a £25 administration fee unless otherwise agreed. This will be deducted from any final balance of monies due in the refund

If you have paid your instructor for the tuition you wish to cancel, your instructor will refund you adhering to the same principles as set out above. In all Instances, You should contact your Instructor for a refund.

Limitation of liability

Your instructor and Dynamic Franchises Limited are not liable to you for any loss or damage caused where, and to the extent that:
There is no breach of a legal duty owed to you by the relevant person or body;
such loss or damage is not a reasonably foreseeable result of such a breach;
any such loss or damage, or increase in the same, results from any breach or omission by you
any such loss or damage results from circumstances or matters outside of the reasonable control of the relevant person or body.
Your instructor and Dynamic Franchises Limited shall not, in any event, be liable for losses relating to any business interests you may have including, without limitation, lost profits, lost earnings, loss of opportunity or business or business interruption.
You are reminded that Dynamic Franchises Limited are not parties to the contract for driving tuition itself, which is between you and your instructor, who is a Franchisee of Kan Kan. This does not affect any liability that Dynamic Franchises Limited may have for any loss or damage you may incur which is caused directly as a result of any breach (including negligence) by it or them of any legal duty owed by it or them to you.

Nothing in these terms and conditions will affect any statutory rights you may have as a consumer.

Collection and use of data

Any personal data you provide will be held securely and in accordance with the Data Protection Act 1998.
We will use your personal data for the purpose(s) for which you have provided it. It may also be used for marketing, research and statistical purposes and crime prevention.

We may however need to disclose personal data to a third party so that the service you requested could be provided. It may also be necessary to transfer it to countries outside the European Economic Area. Where this happens, we will endeavour to ensure that any recipient of your data will treat it with the same level of protection as we would.

Your data may be disclosed to regulatory bodies for the purposes of monitoring and/or enforcing compliance with any regulatory rules/codes. If you give us information about another person, in doing so you confirm that they have given you permission to provide it to us to be able to process their personal data (including any sensitive personal data) and also that you have told them who we are and what we will use their data for, as set out in this notice.

In the case of personal data, with limited exceptions, you have the right to access and if necessary rectify information held about you by formal written application to Dynamic Franchises Limited First Floor, Ernest Wilson Building 62, Gelderd Road, Gildersome LS27 7LG
By providing us with your personal data and contact details, you consent to the use of that data and to your being contacted by any Kan Kan member by post, telephone, email, SMS or other electronic means, to inform you about products and services which it considers may be of interest to you. However you can contact Dynamic Franchises Limited in writing at any time to suppress some or all Dynamic Franchises Limited products.

Your calls to the Sales and Customer Service Centre may be recorded for quality monitoring and training purposes.

Facebook Competitions / Giveaways

To enter the competition simply visit https:www.com/DriveDynamicsSchool. Click on our ‘Win! Win! Win! Competition page. You will then need to allow our competition app to access your Facebook information. You will then be able to submit your details and enter. Each valid entry will be screened and a lucky winner will be selected on the date specified on the competition page. Only one entry per person.
This prize draw is open to all residents of the UK, and republic of Ireland who are aged 17 or above with parent/ guardian consent.

The winning campaign will be included in one of our newsletter and will be sent to our data base. The winning person will be mentioned on our Facebook page.
Driving lessons are only available in areas which are covered by Kan Kan instructors.
Lessons are valid for 60 days from the winning date. The minimum age requirement is 17 with parent/ guardian consent.
The prize is as stated and has 0.01pence cash value for redemption.
The winner of the prize draw will be contacted via email.
By entering into this competition you have agreed to the publication of your name and County by participating in this promotion.
Prizes are non-transferable, non-negotiable and no refundable. You cannot offer for sale the prize, or use in conjunction with any other offer or competition. No cash or alternative will be offered.
The Promoters reserve the right to alter, amend or withdraw prizes without prior notice.
The Promoters cannot be held responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries submitted online.
Entries which are submitted after the deadline will not be entered into the competition… Entries which are not submitted in accordance with these terms and conditions will be invalid.
These terms and conditions shall be governed by and construed with English law.
